Appeal planned in underwear case

A defense attorney said Tuesday that he will appeal a prison sentence for a 20-year-old autistic man who pleaded guilty to taking women’s underwear from a rural Saunders County home in 2010.
Jacob J. Fisher of Linwood, Neb., was ordered Monday by Saunders District Judge Mary C. Gilbride to serve 20 to 60 months in prison for attempted burglary. A charge of theft of property valued at less than $200 was dismissed.
Defense attorney Thomas Klein of Wahoo said he advised Fisher to plead guilty because he considered Fisher an excellent candidate for probation. Klein cited Fisher’s lack of a criminal history and health problems as reasons he should receive probation. He also noted that the case involved Fisher entering a neighbor’s unlocked home in Linwood, which is about 30 miles north of Wahoo.
“Because of his (autism), there are psychological issues that come into play, and I would question whether prison would afford Jacob opportunities for treatment or rehabilitation,” Klein said. “I think, however, it is extremely likely that he will be victimized in prison.”
