A Seattle, US “superhero” Phoenix Jones, who was recently unmasked as 23-year-old Benjamin Fodor, was arrested in October after using pepper spray on several people he believed were involved in a fight.

He was charged, but a “proof problem” lead the city attorney to drop the case on Wednesday, according to the Seattle Post Intelligencer.

“Two men at the heart of the alleged fight ran from the scene, and attempts to identify and interview them have been unsuccessful,” Seattle City Attorney Pete Holmes said in a press release.
